Judge wrongly dismissed lawsuit by customer who claimed auto dealer sold him a previously wrecked car: Pa. court

A county judge overstepped his bounds when he dismissed a lawsuit by a customer who claimed a car dealer had sold him a Ford Mustang that had been wrecked and rebuilt, a state appeals court panel has ruled.

Northumberland County Judge Charles H. Saylor tossed out the case Lawrence Pinno Jr. filed after finding Pinno had named the wrong defendants in the case.

That’s not so, the Superior Court found, so it reinstated the suit against the Blaise Alexander auto dealership chain and the Alexander employee who sold Pinno the car.

Pinno filed his suit in 2013, a year after buying the used 2005 Mustang from Alexander Buick Cadillac GMC Truck Inc. in Sunbury, Judge Mary Murray noted in the state court’s opinion.

Pot smell alone can’t form basis for vehicle search, Pa. court rules

ALLENTOWN, Pa. (AP) — A Pennsylvania appeals court reversed a judge’s ruling that state police didn’t have a valid legal reason for searching a car just because it smelled like cannabis, saying she failed to weigh other factors that led to the man’s arrest.

The state Superior Court agreed with Lehigh County Judge Maria Dantos that the smell of marijuana alone is not enough to give police the right to search a car without a warrant. But the appeals court reversed her decision to suppress evidence in Timothy Barr’s arrest, saying Dantos didn’t take other evidence into account in weighing the legality of the search, The (Allentown) Morning Call reported Friday.

The appeals court sent the case back to Lehigh County Court for review. Another judge will handle the case since Dantos has since retired.

Court denies request to dismiss case involving flight refunds, Canadian Transportation Agency – National

A Federal Court of Appeal judge has dismissed an attempt by Canada’s transportation regulator to prevent a hearing on its stance on flight credit for travellers.

Air Passenger Rights, an advocacy group, asked the appeal court in April to order the removal of the Canadian Transportation Agency’s statement on vouchers from its website, which was posted following mass flight cancellations by airlines.

The statement said the agency believes that vouchers or travel credit valid for two years are generally appropriate for airlines to give customers — opposed to refunds — for flights cancelled by carriers due to the COVID-19 pandemic.

In its application, Air Passenger Rights also asked the court to prohibit members of the regulator from dealing with passenger complaints about refunds, arguing that a reasonable apprehension of bias exists based on the agency’s statements.
